The European Centre for Judges and Lawyers, the Luxembourg Antenna of the European Institute of Public Administration, is organizing a seminar on 24 & 25 February 2005:

The New Legal Regime of Movement of Individuals within the Internal Market,

The objective of this seminar is to offer a forum for discussion between experts, practitioners and any interested professionals on the latest guidelines of the Community regarding the free movement of persons in the internal market.

Due to the combined effects of Community case law and the work of the Community legislator free movement has recently become more generalised and homogenous, a very beneficial development indeed. This has come about through Directive No 2004/38/EC of 29 April 2004, the merits of which include the codification of the body of Community law that is currently spread over various texts of secondary legislation. This Directive offers us a more reliable view of changes in our society and guarantees rights better suited to it. For instance, it takes a broad view of the family, maintaining the right of residence in the event of the separation of couples, despite the legal form of the union. In addition, its approach is more liberal as it reconsiders the possibilities offered to Member States to rely on exceptional circumstances of a public nature to restrict the free movement of persons. In this respect, however, the benefit of the Directive in terms of access to justice might be doubtful.

The seminar will address all these issues, including measures of a social nature accompanying the free movement of persons in the internal market.
The seminar is aimed at judges, lawyers, national and international civil servants, academics, experts and others working or interested in this area.
The registration fee amounts to 700 Euro including documentation, beverages, 2 lunches and a dinner.
